In 1965, 13 year-old Mary Beth Tinker and several of her classmates decided to protest the Vietnam War by wearing black armbands to school. The school board which received word of the planned protest passed a preemptive ban. The students arrived in armbands anyway. They were sent home and told they could not return to school until they removed their armbands. The students did eventually return to school but dressed in all black clothing for the remainder of the school year in protest.
Represented by the ACLU, Mary Beth and the other students embarked on a four-year court battle that culminated in the landmark Supreme Court decision: Tinker v. Des Moines. In 1969 the Court ruled 7-2 that students do not “shed their constitutional rights to freedom of speech or expression at the schoolhouse gate.”
Mary Beth Tinker is now a registered nurse and is still actively educating young people about their rights across the country. Read more about this case
