The ACLU of Oregon, ACLU of Northern California, ACLU of Southern California, Institute for Justice and National Center for Law and Economic Justice, and the Rutherford Institute partnered to file a friend-of-the-court brief in a class-action case arising out of Grants Pass, Oregon challenging the city’s practice of imposing fines on people who sleep in public places when they have nowhere else to sleep. The brief argues that the Excessive Fines Clause in the Eighth Amendment to the U.S. Constitution categorically bars imposing fines on unhoused individuals for conduct that is inseparable from the status of homelessness.
