You can still change your legal name and gender marker on Oregon state identification documents, such as drivers’ licenses.

That process has not changed. Oregon DMV issues standard and REAL ID credentials with options for M, F, and X for the gender marker.

The ACLU filed a lawsuit, Orr v. Trump, challenging the Executive Order impacting passports on February 7, 2025.

Can I still update my passport with my gender marker?

On June 17, 2025, a federal court in ACLU’s Orr v. Trump case temporarily blocked enforcement of the Trump administration’s restrictive passport policy barring people from updating the sex marker on their passports.

The preliminary injunction allows many transgender, nonbinary, and intersex people to receive passports with accurate sex markers while this litigation is pending.

Please note that the government may appeal, and if a higher court pauses this ruling, the restrictive policy could return, and pending applications could also be affected.
